Explanation of standard and legal fees

Standard fees

Our standard fee covers all aspects necessary to secure your compensation for a standard claim. With our team of over 400 AirHelpers, we take care of all aspects of your claim. This includes validating your documents, cross-referencing details with weather and flight reports, initiating legal proceedings, and negotiating with the airline.

Throughout this process, we keep you updated at every stage and are available around the clock to address any questions you may have.

Legal fees

The legal fee comes into play when an airline does not cooperate, and we are prepared to defend your rights in court. Legal proceedings can incur costs of up to €1,000, including lawyer fees, court costs, and translation expenses for official documents. To offset these costs, only a nominal surcharge of 15% is added.

It’s important to emphasize that we never retain more than 50% of your compensation as a fee. If we are unsuccessful, you will not incur any costs.

Please note: If your claim involves a flight to or from Brazil, Brazilian terms and conditions and our Brazilian price list for using our services may apply.

2. DEFINITION

It’s important to understand our fees in the context of our terms of use, where all terms used in our fees are defined.

3. FREE SERVICES

Skyright does not charge fees for claim assessment, information services, or if the compensation service does not result in flight compensation.

4. FEES FOR COMPENSATION SERVICE

Our compensation service assists you in obtaining flight compensation from the airline. According to our model, fees are only incurred if we successfully secure flight compensation from the airline on your behalf. We distinguish between the service fee and the legal fee, which are deducted from the potential flight compensation.

Compensation Service (Fee as Part of Flight Compensation):

 

  • Service fees*: 35 %
  • Legal fee*: 15 %

*Inclusive VAT.

Skyright Plus members do not pay any service or legal fees for the compensation service. Instead, a membership fee applies, as explained below.

Service fees:

For each successfully claimed flight compensation, the service fee is 35% of the total amount of flight compensation, including VAT.

Legal fee:

The legal fee is only charged when legal action is necessary. It amounts to 15% of the total amount of flight compensation, including VAT, and is deducted in addition to the service fee.

Legal pursuit costs:

Skyright covers the legal pursuit costs and court fees on your behalf. In case of success, these costs are reimbursed by the airline; otherwise, Skyright bears them.

Skyright does not charge legal costs or court fees unless you withdraw from the compensation service after legal proceedings have been initiated, or you violate the terms of use.

Notice for Danish customers:

The fees for the compensation service are fixed. Service fee: typically 35%, Legal fee: typically 15%.

Notice for Swedish customers:

Skyright covers the registration fee for legal proceedings on your behalf. Legal pursuit costs are based on the hourly rate of a lawyer.

Goodwill gesture:

For a goodwill gesture, the fee is $29.99 USD. Skyright waives it if the flight compensation is (i) less than $30.00 USD or (ii) less than 3,000 loyalty points.

5. SKYRIGHT PLUS-MEMBERSHIP FEES

Skyright Plus members use the compensation service without additional service or legal fees. Membership fees vary depending on the tariff.

*Individual booking fees are agreed upon between you and the sales provider.

6. SPECIAL FEES FOR CUSTOMERS OF TRAVEL AGENCIES OR OTHER BUSINESSES

Usage is subject to the terms of use unless a separate agreement by the travel agency or company specifies different payment terms.

7. TOTAL AMOUNT OF FLIGHT COMPENSATION

Skyright pays you the full amount of flight compensation, minus our fees, in the prescribed currency.

8. INTERNATIONAL BANK TRANSFERS

Skyright offers international bank transfers free of charge, but does not cover any additional costs from other payment service providers or recipient banks.

9. CHECK PAYMENTS IN USD

Check payments in USD are possible without additional Skyright fees. However, the recipient bears the costs of check cashing.

10. VALUE ADDED TAX/SALES TAX (VAT)

All fees in our price list include VAT unless otherwise stated. In case of discrepancies, the English version takes precedence.

11.  FEES FOR PROCESSING ASSISTANCE

Processing Fees:

  • 16 CHF per Passenger (Flight Schedule Change/Cancellation)
  • 42 CHF per Passenger (Changes/Cancellations)
  • 68 CHF per Passenger (Refund requests after departure)
